MĀORI LAND COURT FORMS AND DOWNLOADS

Navigating Māori Land Court forms can feel overwhelming — especially if you’re not sure which form you need or how to use it.

This page brings together official Māori Land Court forms in one place, so whānau can download what they need with confidence. Each form listed here is the official Court version, provided for convenience.

Form 21 – Succession (With Probate or Administration)

Used when a landowner has passed away, and probate or letters of administration have been granted.

Form 23 – Whānau Trust (Succession Only)

Used during succession to place the deceased person’s shares directly into a Whānau Trust, instead of individual names.

Form 37 – Ahu Whenua Trust

Used by landowners to create an Ahu Whenua Trust to manage Māori land collectively for development or ongoing use.

Form 40 – Occupation Order

Apply for the right to live on or build on a specific house site on Māori land.
This does not change ownership of the land.

Form 30 – Vesting Order

 

Used to formally vest land or shares into trustees or new owners following a Court decision.

Form 53 – Special aid

 

Used to apply for financial assistance from the Māori Land Court to help cover reasonable legal fees or out-of-pocket costs in certain land or trust proceedings.

 

This is not Legal Aid and is assessed by the Court.

B1 – Consent of Trustee

 

Used by proposed or existing trustees to formally confirm their consent to act as a trustee in a Māori Land Court application.

Form 22 – Succession (No Probate)

Used when a landowner has passed away without a will or probate so that shares can be transferred to whānau.

Form 36 – Whanau Trust

Used by living owners to place some or all of their Māori land shares into a Whānau Trust to be held for the benefit of their descendants. This form is not used for succession.

If the owner has passed away and the trust is being created as part of succession, use Form 23 instead.

A sample Court-style trust order showing how an Ahu Whenua Trust may be structured. Used as a guide when preparing or reviewing an application to constitute an Ahu Whenua Trust. This is a template only and must be approved by the Māori Land Court to take effect.

Form 31 – Agreement to sell or gift

Used to record an agreement to sell or gift Māori land shares to another person. This form supports an application to the Māori Land Court for approval — the transfer does not take effect unless the Court approves it.

Form 38 – Application to Add, Reduce, Replace, or Remove Trustee(s).

Used to add, replace, reduce, or remove trustees of an existing Māori land trust.

This form is commonly used after an AGM or hui, or when a trustee resigns, passes away, or can no longer act.
Any change must be approved by the Māori Land Court before it takes effect.

Form 1 – General Application

 

Used to apply to the Māori Land Court for matters not covered by a specific form. This form is often used to request directions, orders, or approvals where no dedicated application form exists.

Document A1 – Request for Fee Waiver

 

Used to ask the Māori Land Court to waive, reduce, or refund the Court filing fee if you are unable to pay. This does not cover legal fees or other costs.
